Naadu, Mills' son must benefit from Mills' ex-gratia- Faibille

An Accra-based legal practitioner is urging government to transfer the End of Service Benefits that would have accrued to the late President John Mills to his wife, Naadu Mills and son Kofi Mills.

Though the constitution makes provision for ex-presidents and public office holders to be paid ex-gratia and emoluments, such entitlements cannot be transferred to their survivors such as spouses and children.

But lawyer Egbert Faibille believes government will have to make a special case this time because of the peculiar circumstances under which the late President exited office.

He said all entitlements of the late Mills should be passed on to the wife and son of the late president who died on July 24, 2012, two day after his 68th birthday.

“President Mills is no more. Is it the lump sum that is going to be paid to his widow and son? Is president Mills entitled to an official residence? If so then it has to go to the widow and son," he quizzed.

He said the country must, going forward, take a closer look at how it caters for a family of a deceased sitting president.

Faibille said even PNDC Law 111 provides for widows to be taken care of under the constitution, insisting a definite decision must be taken on how to treat the immediate family of a late president.
