Koku Anyidoho is a liability

The government’s communication team is divided over Koku Anyidoho’s gaffe which occurred last Friday where he purported President Mills has fired the Ashanti regional ECG boss over the black out at the Baba Yara Sports stadium during the Ghana-Lesotho World Cup qualifier.

 A member of Communication team, Samuel George, in an interview with Radio Gold, said the “ill-thought and not-thought through” statement by the Communications Director at the Presidency has brought a “litany of disgrace” not only to the castle but to President Mills.

The communication team member accused Koku Anyidoho of making “cowardice oriented statements" against him but which subsequently tended to cast the president in a bad light.

According to Samuel George, as the December elections approach, “they will make sure oafs like Koku Anyidoho do not affect the candidature of His Excellency”. 


 He further accused Koku Anyidoho of sending threatening text messages to government functionaries who are not in his good books.

He called on President Mills and the entire government’s communications team to re-assess the role of Koku Anyidoho who he says is more of a liability than an asset in the government’s communication machinery.

Meanwhile, another member of the government’s team, Ibrahim Murtala Mohammed who is also the deputy Coordinator of the National Youth Employment Programme says Koku Anyidoho’s statement is not extraordinary to warrant his sack.

According to him, Koku Anyidoho’s gaffe should have been put to bed with his apology adding that the blunder must not create an impression that the Communication’s Director at the Presidency is not credible.

He questioned the judgement of Joy FM in reporting the issue as one of its news items.

Nightmare scenario looms in South Sudan, aid groups warn

In a few weeks, South Sudan will turn a year old. It ought to have been a joyous occasion.
Instead, the world's newest nation is coping with a massive humanitarian crisis wrought by fighting between the armed forces of its nemesis to the north and an affiliate rebel movement.
The fighting is hardly new. For decades before South Sudan's independence in July, civil war raged over territory, oil and religion. Now, aid groups warn that another nightmare looms as millions of people are on the move, desperate to flee fighting and find a safer place to live.
The United Nations refugee agency said this week that the situation had sharply deteriorated in South Sudan's Upper Nile state, flooded with refugees crossing the border from Sudan.
About 150,000 refugees from Sudan are currently in South Sudan. That presents an enormous logistical challenge for aid agencies.
"This is a dramatic change in an already difficult humanitarian situation," said Antonio Guterres, the U.N. high commissioner for refugees.
"Not only are refugee numbers suddenly much higher, but the condition that many of these people are in is shockingly bad," he said. "Some have been eating tree leaves to survive along the way."
In a statement issued Wednesday, the United States expressed its concerns over the dire situation in South Sudan. Deputy State Department spokesman Mark Toner urged international partners to join the efforts "to relieve suffering and assist those affected by the ongoing violence."
The United States government said it "has stepped up to help prevent further suffering" by providing more than $34 million to support the emergency response to new Sudanese refugees in the region The United Nations High Commissioner for Refugees has appealed for $145 million to help resolve and prevent a humanitarian crisis in the region.


Enough Project, which works to stop genocide and crimes against humanity and has been monitoring the situation along the Sudanese border, blamed Khartoum for targeting civilians.
"The refugees are pouring into South Sudan because the government of neighboring Sudan is using starvation as a weapon in its South Kordofan and Blue Nile regions," said John Prendergast, co-founder of Enough Project.
In temporary refugee camps, people are living in wretched conditions, say international charities working in the area,
Jean-Marc Jacobs, head of the Medecins Sans Frontieres mission in South Sudan, described the transit camp of Rim as a remote and inhospitable place where people are seeking shelter under the shade of trees.


"People have walked for several days with no food and no water," he said.
The agency has been running a substantial emergency medical operation for the refugees in Upper Nile State.
This week, Medecins Sans Frontieres called on the United Nations to identify a suitable place for more than 30,000 refugees who have crossed the border from Sudan's Blue Nile State into South Sudan's Upper Nile State over the past two weeks.
Many are hungry and face other dire problems like not having access to clean water and proper sanitation.
But it's not just refugees who are suffering.
"The ones who are strong enough to make the long trek to the border do so; the ones left behind face a bleak future," Prendergast said.
Another monitoring group, Amnesty International, visited eight refugee camps between March and April and found people in some instances waiting 10 hours to receive a single container of water or three weeks for food rations.


Amnesty International also documented human rights abuses.

People "faced risks such as forced recruitment into armed groups and sexual violence, in addition to food and water shortages," the group said. Women and girls spoke of their fear of rape and sexual violence.
In refugee camps in Upper Nile State, Amnesty received reports of "boys and young men being forcefully recruited into the armed opposition group, the Sudan Peoples Liberation Movement-North."
"We can run away from bombs but not from hunger," one refugee told Amnesty International.
Amnesty urged the United Nations to accelerate efforts to feed people and to make sure protective measures are in place for the vulnerable.

Despite the bleak reality in South Sudan, many of its people are eager to return home.
This week, the International Organization for Migration relocated more than 6,000 South Sudanese from Khartoum to Juba. The operation between the two capitals took more than 11 days and about 40 flights.

The majority of the returnees were previously stranded in Kosti, 300 kilometers (186 miles) south of Khartoum.
It's not even 1 year old, and South Sudan is facing myriad problems, Prendergast said,
"The cutoff of oil production, state corruption and a state of near-war with Sudan have created massive hardships among the civilian population in South Sudan," he said.
He said it was imperative for the United Nations Security Council to make good on its threat to impose sanctions -- on Sudan and on South Sudan -- if they continue to impede progress toward a lasting peace deal and an end to the fighting.
The challenges are many. Still, South Sudanese are optimistic about their return.
"I left South Sudan in 1951, when I was just a boy," Amol Jok Ajak Deng told the International Organization for Migration.
"I return as an old man, but I am strong, and I am willing to work."

RIHANNA INSULTS JOURNALIST FOR INSULTING CHRIS BROWN

Rihanna recently blasted a British journalist for bringing up her 2009 domestic assault case against Chris Brown less than one month after the singer stopped following him on Twitter due to a reported feud.

During an interview for Esquire UK's June edition, the 24-year-old appeared to get defensive when the interviewer questioned the motive behind her recent collaboration with Brown for the hit song "Birthday Cake," according to The Urban Daily.

"And that's how f----- up society is. There's a lot of s--- y'all can't get over. Y'all holding your breath on a lot of stuff that doesn't matter. When you realize who you live for, and who's important to please, a lot of people will actually start living," Rihanna said.
"I thought people were gonna be surprised that we finally did a record together, but I didn't see how people could think it was a bad thing, you know? In my mind, it was just music," she added.
The journalist explained that some critics believe that Rihanna and Brown's recent collaboration "sent the wrong message" to fans because ultimately she went "back to someone who put [her] in the hospital" which did not sit well with the Bajan singer.

 "I am never going to get caught up in that. I'm gonna look back on my life and say that I enjoyed it – and I lived it for me- and God. This is turning into a tacky interview. What do you really want to talk about? I'm not here to [talk] about messy s---," Rihanna shot back.


Brown, who is currently dating model Karrueche Tran, recently upset Rihanna with the lyrics in his remixed version of Kanye West's "Way Too Cold" song and although they pair unfollowed each other on Twitter, she remains confident about the possibility of a romantic reconciliation.
"If I went back to him [as a girlfriend], then that's a whole different discussion. And if I ever do, then that's something that y'all have to talk to me about when – if – that ever happens. Until then, look at it for what it is. I think a lot of people jumped to an assumption that was incorrect and they ended up looking stupid," Rihanna said.

PNC TO SUPPORT JAKE OBETSEBI-LAMPTEY TO GET BACK HIS PROPERTY

STATEMENT OF THE PEOPLES' NATIONAL CONVENTION ON THE DECISION OF THE SUPREME COURT IN SAMUEL OKUDZETO ABLAKWA AND DR. EDWARD KOFI OMANE BOAMAH (PLAINTIFFS) VRS. THE ATTORNEY-GENERAL (1st DEFENDANT) AND HON. JAKE OTANKA OBETSEBI-LAMPTEY (2nd DEFENDANT)

SUIT NO. J1/4/2009, JUDGMENT DELIVERED ON 22ND MAY 2012



 Ladies and Gentlemen of the Media, Ladies and Gentlemen,

The People's National Convention (PNC) is compelled to issue the following statement on what is now called the Jake Obetsebi-Lamptey case.

The main conclusions on the legal issues in this case are five-fold:

1. The plaintiffs have capacity to bring the suit (9 judges to 0 judges)

2. The claim of the plaintiff's that the grant of the property to Jake Obetsebi-Lamptey is tainted with conflict of interest is not properly before the Supreme Court, since the proper body to deal with complaints about conflict of interest situations arising from the conduct of public officers is the Commission on Human Rights and Administrative Justice (CHRAJ) ((9 judges to 0 judges).

3. The claim of the Plaintiffs that the decision of the Government of Ghana to sell the disputed land to Jake Obetsebi-Lamptey is unconstitutional as smacking of cronyism, arbitrariness, capriciousness, and discrimination has not been proven by the Plaintiffs and therefore fails (9 judges to 0 judges). 


 4. The claim of the Plaintiffs that the decision of the Government of Ghana to sell the disputed land to Jake Obetsebi-Lamptey is unconstitutional as being a gross abuse of discretionary power has not been proven (6 judges to 3 judges).

5. Mr. Jake Obetsebi-Lamptey may keep the disputed property, since his title to it has not been successfully impugned by the Plaintiffs (6 judges to 3 judges).

There are some good things about the judgment of the Supreme Court summarised above.

First, the attempt to impugn the capacity of the plaintiffs was disallowed by the Supreme Court. This is very good news because in similar cases in the Supreme Court, some judges have held that such a right did not avail the Ghanaian citizen. In this regard, it is commendable that the Supreme Court has emphatically stated that where a citizen alleges on concrete grounds that a provision of the Constitution has been violated that citizen should be given unrestricted access to the Supreme Court to vindicate her claim.

This is a plus for democracy and good governance. 


 We must indeed congratulate the Supreme Court for reaching the first conclusion which reaffirms the principle of almost unfettered access to the Supreme Court to vindicate any claim that a person has acted unconstitutionally. This is important if ordinary citizens are to continue to participate meaningfully in growing and nurturing our young democracy.

We again congratulate the Supreme Court for reaching the second conclusion. The Constitution is crystal clear that any complaint concerning conflict of interest of a public officer must be reported to the CHRAJ to be dealt with in accordance with the provisions of the Constitution. The Supreme Court did well by giving effect to the clear and unambiguous provisions of our 1992 Constitution.

The third conclusion of the Supreme Court cannot also be quarreled with. There was some, but not enough evidence from which to conclude that there was cronyism, arbitrariness, capriciousness, and discrimination in the allocation of property under the Accra Redevelopment Scheme. Where a person alleges that another has acted inappropriately, she must prove same, unless in appropriate cases the burden is shifted to the defendant.

The last two conclusions of the Supreme Court are however problematic. 


 It is clear that the 1992 Constitution requires that public lands be held in trust for the people of Ghana and used in the interest of the public. Indeed, Article 36(8), which the Supreme Court has now held is justiciable, provides that: "The State shall recognise that ownership and possession of land carry a social obligation to serve the larger community and, in particular, the State shall recognise that the managers of public...lands are fiduciaries charged with the obligation to discharge their functions for the benefit...of the people of Ghana...concerned and are accountable as fiduciaries in this regard". Further, clause (1) of article 34 enjoins the Judiciary to be guided by the Directive Principles of State Policy contained in Chapter Six of the Constitution, including Article 36(8) “in applying or interpreting [the] Constitution or any other law and in taking and implementing any policy decisions for the establishment of a just and free society”. The parceling out and dolling out of public lands in choice communities in the heart of the administrative district of Accra, the capital city, to private interests, without more, cannot be said to be in the public interest given the need for accommodation by public officials in areas close to the part of town where they work. 

 Again, the allocation of the house to Jake Obetsebi-Lamptey was not done in accordance with the rules set out for same and was consequently not fair and transparent, did not receive the input of cabinet, and did not received the input of the minister responsible for lands as required by Article 258 of the 1992 Constitution.

The extent, to which the Supreme Court went to impugn the integrity of an extract of the minutes of Cabinet on the proper procedure that was agreed for the allocation of lands, in the absence of a claim by any of the parties that the extract was not authentic, is suspicious indeed. Both the Plaintiffs and the Defendants relied on the document to make their arguments, further reinforcing the presumption that they are an extract from the regular minutes of the Cabinet.

The fact that they were submitted by and sworn to by the Attorney-General's office on pain of perjury should ensure that they are presumed to be regular unless otherwise stated.

It is worrying that the majority of judges in this case were dead set on ensuring that the transactions leading up to the allocation of the disputed house to Jake Obetsebi-Lamptey were rationalised in the face of clear evidence that the transactions breached clear and unambiguous provisions of the 1992 Constitution, in particular Article 258. 


 
It is clear that the majority decision of the Supreme Court based their decision on a strict constructionist and narrow interpretation of the Constitution. This is contrary to the clear terms of the Interpretation Act which provides in its Section 10(4) that "a Court shall construe or interpret a provision of the Constitution or any other law in a manner...that promotes the rule of law and the values of good governance...that advances human rights and fundamental freedoms...that permits the creative development of the provisions of the Constitution and the laws of Ghana, and...that avoids technicalities and recourse to niceties of form and language which defeat the purpose and spirit of the Constitution and of the laws of Ghana. What the majority of the Supreme Court did in this case was to use technicalities to ensure regress in good governance and plunder the spirit of the Constitution.

The insistence by the Supreme Court, in the absence of any objection by any of the parties, and in the face of reliance on it by all the parties in the suit, that a Cabinet document, sworn to and exhibited by no less a person than the representative of the Minister for Justice and Attorney-General, is not authentic, and the use of this reason as a smoke screen for allowing unconscionable actions by public officers is dangerous, especially in the face of gargantuan difficulties in accessing public documents and the absence of a freedom of information Act. 


 The irresistible conclusion is that by arriving at the fourth and fifth conclusions above, the majority of the Supreme Court ignored the clear, patent and easy to understand provisions of the 1992 Constitution on the matter.

In Tema Development Corporation and Musah v. Atta Baffour [2005-2006] SCGLR 121, it was held that our courts will not allow a decision which "is so outrageous in its defiance of logic or of accepted moral standards that no sensible person who has applied his mind to the question to be decided could have arrived at it. Whether a decision falls within this category is a question that judges by their training and experience should be well equipped to answer, or else there would be something badly wrong with our judicial system."

The PNC fears that the Supreme Court is departing from these enviable standards it has set itself and that, in their own words, there is "SOMETHING BADLY WRONG WITH OUR JUDICIAL SYSTEM".

The greatest challenge to our current democracy is the question of what we should do when the Supreme Court (in some cases the High Court), which has the exclusive jurisdiction to interpret and enforce the Constitution, neglects to do so


 There have been three reactions by Ghanaians to decisions of this kind by the Supreme Court. The first has been that beneficiaries of these decisions of the Supreme Court have hailed them. This is unacceptable and must be condemned in the strongest possible terms.

The second reaction has been to say nothing and do nothing about the decisions. This is also not acceptable. This is because the Constitution demands that all Ghanaians must defend the Constitution, even unto death.

The third reaction has been to make statements or take steps that do not allow for the realization of the benefit of the decision. This is what the current government has done by stating that it will not release the disputed house to Jake Obetsebi-Lamptey. Again, this is unacceptable and must be condemned.

None of these reactions have been able to restore to us a Supreme Court, like the Supreme Court of old, which was able to say to the government that appointed them that it could no longer celebrate the anniversary of the coup d'état which brought them to power; which was able to say to the national broadcaster, then under the control of the ruling party, that it must give equal treatment and facilities to all political parties; which was able to quash permit laws that prevented peaceful demonstrations by opposition forces against policies of the ruling government.


 A related concern of the PNC is that “Trust in the Ghanaian courts is minimal according to recent studies on the subject. The March 2008 Round 4 Afrobarometer Survey in Ghana confirms this assertion. The study showed that only 30% of respondents had a lot of trust for the courts in Ghana. Luckily, 28% had somewhat trust in the courts and 23% had just a little trust in the courts, while 15% did not trust the judicial institutions at all...Comparing the...scores on trust in the courts to what obtained three years earlier, it is observed that the level of trust in the courts has dropped. The 2005 Survey showed that 35% of respondents had a lot of trust in the courts."

The Supreme Court is not making it any easier for Ghanaians to trust them.


Another concern of the PNC is that this is an election year and many matters, including electoral disputes, may come to the courts for adjudication. Ghanaians need to trust that the judges will decide these cases constitutionally and fairly. Ghanaians need to know that the courts will protect the interest of the larger public and decide cases fairly. This is the surest way to assure the integrity of the State by ensuring that the citizens the use courts of law to settle their disputes rather than resort to extra judicial measures.

In the light of the above:

1. The PNC calls on the Government of Ghana to adapt the Accra Redevelopment Policy and any other policy of similar nature to serve the interest of the large public.

2. The PNC calls on Ghanaians who are praising the majority decision of the Supreme Court to stop same forthwith.

3. The PNC calls on all Ghanaians to use temperate and productive language to register their displeasure with the decision 
of the Supreme Court.

 
4. The PNC calls on the Plaintiffs and the Attorney-General to immediately apply for a review of the decision of the Supreme Court.

5. The PNC calls on Ghanaians to remain vigilant and persevere, using only legal mechanisms to secure the reversal of the decision of the Supreme Court.

6. The PNC calls on the Supreme Court to ensure that its decisions inspire public respect and confidence in the judiciary.

7. The PNC finally calls on the judiciary to ensure their decisions in election matters in this election year, and soon thereafter, are so patently fair and just that peace in Ghana would prevail.

The PNC promises in the interest of our beloved Ghana, to assist the Plaintiffs with the full complement of its team of legal experts in order to seek a reversal of the majority decision of the Supreme Court.

2face Now A Pastor

Newly wedded Innocent Ujah Idibia popularly called 2face turned ‘pastor’ in Ibadan while performing on the Star Trek stage on May 25, 2012.
The concert held at Adamasingba Stadium.While thrilling audience the singer went into a trance of sorts, praying and prophesying, telling his fans ’we shall be blessed‘, ‘I see a greater future‘.  ’Receive it‘, he told them, filling his set with motivation and inspiration.
After his touching session, he then used his songs to arouse his audience’s spirit, calling for solidarity actions towards the present situation in the country. ‘For instance’ and  ’One love’ were his favourite songs of the night as he boldly modified the lyrics, inserting conspicuous political messages that spoke directly to Government officials.
The crowd watched and listened in absolute silence.
At the end of Idibia’s performance, the audience could not but remain standing for minutes; and it took many sometime, before regaining their ‘consciousness’.

Search ends for victims of Nigeria plane crash

The search for bodies of those killed in a plane crash in Nigeria's major city of Lagos has ended, authorities said Wednesday.
So far, 153 bodies have been recovered along with parts of other bodies, said Yushau Shuaib, spokesman for Nigeria's National Emergency Management Agency.
Dana Air's flight 0992 slammed into a two-story residential building Sunday in a densely populated Lagos neighborhood.
Shuaib could not give a number for recovered body parts. Authorities previously said the crash killed 153 people aboard the plane and at least 10 people on the ground.
Torrential rain Tuesday hampered recovery efforts. Among the bodies recovered were those of a woman and the baby she was clutching.

Nigerian aviation authorities suspended Dana Air's operating license Tuesday.
"As soon as we have concluded the recertification of the airline, if they are capable, then their license will be reinstated," said Sam Adurogboye, spokesman for the Nigerian Civil Aviation Authority.
Authorities have recovered the flight data recorder and the cockpit voice recorder, which are expected to help determine the cause of the crash.
Seven U.S. citizens were aboard the flight, State Department spokesman Mark Toner said Tuesday.
The pilot declared an emergency as the plane was on final approach to Murtala Muhammed International Airport. Witnesses said it appeared the plane was having engine trouble, said Oscar Wason, Dana Air's director of operations.
"The plane pushed the wall of our building in, and it hit everything," said Kingsley Okeke, who was inside at the time. "There was fire everywhere."
Wason identified the pilot as Peter Waxtan, an American, and the first officer as Mike Mahendra from India.

Waxtan joined Dana Air on March 26. He was a captain for Spirit Airlines, based in South Florida, from 1997 to 2009, the airline said. He also flew for Falcon Air Express, a charter airline in Miami, CNN affiliate WPEC reported.
Sisters Jennifer and Josephine Onita of Missouri City, Texas, were among those killed in the crash. They were on their way home after attending a wedding, said their sister, Christiana Onita-Olojo.
Also among the dead were six Chinese citizens who were on the plane, the Chinese Embassy in Nigeria said Monday.
According to witnesses, the passenger plane appeared to be approaching the vicinity of the airport in Lagos high, its nose tilted upward, when it crashed 11 miles (18 kilometers) north of the runway, hitting the ground tail first.
The flight, which had originated in the Nigerian capital of Abuja, crashed at 3:43 p.m. in the neighborhood of Iju Ishaga, according to the Nigerian Civil Aviation Authority.
The airline, which is privately owned and based in Lagos, began operations in 2008.

"THE STATE HAS WASTED MY TIME" WOYOME

Embattled businessman, Alfred Agbesi Woyome, who thought he had been discharged and was therefore a free man after the Attorney-General’s Department filed a nolle prosequi on Tuesday, has expressed disappointment at the decision by the state to re-arrest him.

 The self-confessed NDC financier was in a happy mood after the state said it was no longer interested in pursuing the case against him. 


However, his freedom was short lived when he was re-arrested and slapped with fresh charges of defrauding by false pretence and causing financial loss to the State to the tune of GHc51.2m.

Mr Woyome was re-arraigned before the court, following his re-arrest after being discharged.

Whilst Chief State Attorney, Samuel Nerquaye-Tetteh, who was facing two counts of conspiracy and corruption of a public officer, his wife, Gifty Nerquaye-Tetteh and Director of Legal Services of the Ministry of Finance and Economic Planning, Paul Asimenu - each of the three was facing one count of abetment of crime - were allowed to walk free, Alfred Woyome was rearrested immediately and fresh charges proffered against him.


 But Woyome is unhappy at the turn of events and feels slighted.

His Special Aide, Kwame Tawiah, argues that the rights of his boss have been trampled upon and his precious time wasted.

Speaking to the issue in an interview on Citi Eye Witness News, Mr. Tawiah said the state should have investigated the matter thoroughly before trumping up irrelevant charges and going ahead with proceedings and ‘wasting the business time’ of Mr. Woyome.

According to him, Mr. Woyome has been denigrated and disgraced as an individual.


 
“His whole business time has been wasted and then fresh charges have been leveled against him and it seems like we are just running around. They should have done proper investigations before starting the proceedings. Do we think about the human rights aspect of Woyome?…he feels very disappointed because it has been a waste of his time. How can you waste his time like this? Now we are back at square one to start a new case? Where are the Human Rights lawyers?” he asked.

Hannah Tetteh Replies Rawlings

Hannah Tetteh, Minister of Trade and Industry has stated candidly that the National Democratic Congress (NDC) is facing some hard times in its evolution as a political party. She however believes the storm will be over soon.Speaking on Breakfast XYZ on Radio XYZ 93.1 FM on Tuesday, Madam Tetteh said “I think that the NDC is going through quite a trying period. I think this is going to be a test of our resilience. But I am confident we are going to come out stronger.”
 
She said despite all the wrangling that inundated the party after it lost the elections in 2000, members were able to rally behind Prof. Mills to win the 2008 polls.

 Last Sunday, former President Rawlings, founder of the party told a gathering at Aflao at a ceremony to mark the June 4 uprising in 1979 that the party is already in a ditch. He said the party cannot win the 2012 General Elections if it does not return to the values of the June 4 - Probity, Transparency and Accountability.

But Madam Hannah says such a comment is disrespectful to the hardworking members of the party who braved the odds to make the party strong.


 She said “I don’t think we are in a ditch because I know that there are people within the party who go out and work for this party and put their hearts into it,” adding “when we make comments like that, we don’t respect the rank and file of the NDC.”

Touching on the June 4 values, Madam Tetteh indicated that “I think that June 4 is important, but so is 7th January…I wish that we will also begin to celebrate 7th January.”

Her reason? “The structure of the organisations that were created and the institutions that were created after 7th January by the P/NDC government are the structures that have given us the democratic dispensation that we are enjoying today.”



She said President Mills has shown maturity and tolerance in not responding to the mud thrown at him by people within and outside the party. According to her, the president is focused on the collective interest of the Ghanaian population and not on his parochial one.


 “In this government, I think that President Mills led my example. He has been extremely tolerant. He has not responded to everything that has been thrown at him because he is of the view that it is not about him; it is about the country.”

Madam Tetteh said President Mills recognizes that it is irrelevant for him to make “grandiose pronouncement” when there is a need to strengthen systems that fuel the democratic system.

She further denied accusations from the former president that the party has veered off the agreed course prior to victory in the 2008 elections, explaining that the party has been working to ensure that it achieves what is contained in the manifesto.

Asked whether the aggrieved former president will join the campaign trail of the party, Madam Hannah Tetteh stated that:
“The election campaign will involve every member of the party. This is a grassroots party and elections are won polling station to polling station, vote to vote. I have no doubt that the NDC will rally to make sure that we win this elections.”

Responding to a question by a caller as to whether she ever told the US Embassy that she will sell the NDC to the Convention People’s Party (CPP), Madam Tetteh said “Wikileaks is reported speech. At no point in time did anything in Wikileaks say that this is a transcript… If you look at the original Wikileaks transcript, I never said anything like that. Not the summarized version that appeared on Ghanaweb, but the original version. I never said anything of the kind.”

Madam Tetteh explained that she was asked about how to help the smaller parties to which she responded that the parties with similar ideologies must come together to fight a common course instead of living in splitter groups.

ALFRED WOYOME HAS BEEN REARRESTED

Shortly after Alfred Woyome has discharged, he has again being re-arrested and has proffered against him.

Mr. Woyome, interdicted Chief State Attorney, Mr Nerquaye-Tettey; who was facing two counts of conspiracy and corruption of public officer, his wife, Gifty Tetteh-Nerquaye and Mr Asimenu; each facing one count of abetment of crime, were standing trial for their roles in the infamous GHC51 million judgment debt payment paid to Mr Woyome as compensation for the abrogation of a contract to build stadia for the 2008 African Cup of Nations.

They have all pleaded that they are not guilty of the crimes proffered against them. Many people have been shocked because minutes after the man was discharged he has been re-arrested again.

The controversial judgement debt case has taken another u-turn. Alfred Woyome has been discharged by the High Court.

The state has declared that it has no interest in the case again. The state prosecutors led by Cynthia Lamptey told the court that it is no longer prosecuting the matter again.

Libyan forces have regained control of the main airport in Tripoli, after an armed militia overran the runway demanding their leader's release.
Dozens of the militiamen who drove armoured trucks onto the runway forcing flight diversions have been arrested, Libya's deputy interior minister saidEarlier, gunfire was heard when troops and other militias entered the airport to oust the brigade.
The al-Awfia brigade had refused to leave until their demands were met.
It is unclear exactly how the stand-off was resolved and whether the government made concessions to the brigade.
The BBC's Rana Jawad in Tripoli earlier witnessed armoured vehicles carrying security forces and militiamen from various armed brigades entering the airport to evict the occupying force.
There have been no reports of casualties, although Omar Khadrawi, Libya's deputy interior minister, said a hangar had been blown up and a field set alight.
"The authorities have complete control over the airport," Mr Khadrawi told journalists in Tripoli.
He described the militia that occupied the runway as saboteurs.

 Commander kidnapped'
The group, from the town of Tahrouna in western Libya, began the occupation in protest against the disappearance of one of their commanders.
It is not clear where the man is or whom he is being held by.
"One of their leaders yesterday was coming to Tripoli with two tanks, and at an inspection point they found no documents... so they took the guns and tanks from him and he returned back," Mohammed el Harezi, a spokesman for the Libyan government, told the BBC.
"Then suddenly this guy, he was kidnapped, he disappeared. So this is the group who supported him. They came to the airport asking for his release and they thought he might be in the airport area," he added.
The spokesman said that the force agreed to leave after negotiations.
The brigade had placed a pick-up truck mounted with an anti-aircraft gun underneath each of the six planes on the tarmac, our correspondent says.
Airport sources told the BBC that at least three airlines had to cancel their flights.
Several international airlines have resumed flights to Libya since the end of the conflict which toppled Muammar Gaddafi.
Libya's interim government took control of the airport in Tripoli in April, taking over from militia fighters who held control until then.
Tripoli says the international airport will be shut for the next 24 hours to resolve technical issues.
The incident comes as Libya's governing National Transitional Council prepares to hold elections for a constituent assembly in the coming weeks.

One dead; six wounded in Kokomba, Bemoba clashes

One person has died and several people have sustained serious degrees of wounds as a result of the fight between the Kokomba and the Bemobas all in the Northern Region. The conflict is said to have been caused by a land dispute which have resulted to the burning down of hundreds of houses.

The aforementioned ethnic groups were seen to have exclaimed gun shots in the early hours of Monday.

.Nasaamu Asabigi said uneasy calm has returned following the police and military presence in the area.

He said the casualties have been sent to the Nalerigu Hospital but cannot say the seriousness of the injuries.

He said the security personnel will be present in Kpanyili, a village near Nankpanduri as long as necessary to maintain law and order.

Asabigi noted the police have begun investigations and will bring perpetrators to book.

He also warned of reprisal attacks which he said will not be in anybody’s interest

Rawlings: NDC will lose 2012 polls for shunning June 4 ideals

Former President Jerry John Rawlings has dealt yet another verbal blow to the National Democratic Congress and its executives, saying the party will lose the 2012 elections for throwing away the values and ideals of June 4.

According to him, the current crop of NDC members, especially those in leadership are leading the party in a different direction, far from the principles and values on which the party was founded.

He was speaking at Aflao in the Volta region as part of the 33 Anniversary celebration of the June 4 Uprising.
 The Former President has, however, endorsed his wife as the best presidential candidate for the country in the December polls saying that she would be able to save the country from the current leadership paralysis.

He pleaded with the people to consider giving her the needed support to rule.

Former President Rawlings indicated that the NDC members, whom he referred to as traitors have plotted to destroy the party and strengthen the Convention People's Party (CPP).

NIGERIA MOURNS PLANE CRUSH VICTIMS

Three days of mourning have begun in Nigeria for more than 150 people killed when their plane crashed in the main city of Lagos.
The Boeing MD-83 ploughed into a printing works and residential buildings before bursting into flames.
Rescue workers have been at the scene through the night.
Everyone on board the aircraft died. There were also casualties on the ground, but it is not yet known how many people were killed.
The airliner, operated by Lagos-based company Dana Air, had flown in from the capital, Abuja, when it crashed and burst into flames.


It came down in the Iju area, just north of the airport.
Casualties on the ground may have been minimised because it was Sunday and the buildings were likely to have been empty.
There have been distressing scenes as people have found out that they had relatives and friends on board; most of the passengers were Nigerian, says the BBC's Will Ross in Lagos.

The Chinese embassy said six of its nationals died.
In a statement, President Goodluck Jonathan said he had ordered the "fullest possible" investigation into the crash.
Safety questions
On 11 May, a similar Dana Air plane - possibly the same one - developed a technical problem and was forced to make an emergency landing in Lagos, our correspondent says.
Nigeria, like many African countries, has a poor air safety record, though some efforts have been made to improve it since a spate of airline disasters in 2005.
Questions are now being asked about the general safety of aviation in Nigeria, as this is the fourth crash in the last decade in which more than 100 people were killed, our correspondent adds.

The website of the Indian-owned Dana Air says it operates Boeing MD-83 planes to cities around Nigeria out of Murtala Muhammed Airport in Lagos.
The airport is a major hub for West Africa and saw 2.3 million passengers pass through it in 2009, according to the most recent statistics provided by the Federal Airports Authority of Nigeria.

Plane Crash: Fact Finding Committee Inaugurated…Mills Visits Accident Scene

A 5 member independent committee has been set up to investigate what exactly led to an Allied Air Boeing 727 cargo plane with 5N-BJN embossed on it, overshooting the runway at the Kotoka International Airport and smashing through the airport's perimeter fence leaving in its wake littered bodies of passengers.At about 7:10pm on Saturday, flight number DHV 111 operating from Lagos to Accra, somehow when landing, skidded off the runway, broke through the perimeter fence and went across the 37-Burma Camp road near the El-Wak Sports stadium and the Hajj Village, where Muslims in the country stay before they journey to Mecca.

 The committee, which is chaired by Captain Alec Grant Sam, will among other things investigate the extent of the damage and also the cause of the accident.Other members of the committee are Messrs Ben Asare Botuo, Ben Sapaku, Eric Awusi and a representative of the Air Traffic Controller

 The Committee has 30 days to present its report.
 
Preliminary investigations reveal that the Nigerian cargo jet landed in a pool of water during heavy rains before overshooting the runway.


Managing Director of Ghana Airports Company, Doreen Owusu Fianko told the media during a visit to the crash site by President John Atta Mills that "what we know for now is that it was raining at the time and the plane landed in a pool of water and that created some challenges to the pilot."

In a related development, President John Evans Atta Mills wants management of the Ghana Civil Aviation Authority (GCAA) to put in place adequate measures to forestall a similar disaster from occurring.



 During a visit to the accident scene early Sunday morning, President Mills, who expressed his condolence to the bereaved families, also expressed satisfaction at the swift response by the emergency service organisations to the scene which saw the immediate cordoning off of the place to prevent the milling crowd from intruding.

The Commanding Officer of the Fifth Battalion (5BN), Lt. Col. Lawrence Gbetana, conducted the President and his entourage round the accident scene.

 
The President was accompanied by the Greater Accra Regional Minister, Joseph Nii Afotey-Agbo, the Defence Minister, Lt. General Henry Smith, the Accra Metropolitan Chief Executive, Dr Alfred Vanderpuije, the National Coordinator of the National Disaster Management Organisation (NADMO), Mr Kofi Portuphy and the Deputy Health Minister, Mr Rojo Mettle Nunoo.

Passenger plane 'crashes into building in Lagos'

A passenger plane has crashed into a building in Nigeria's main city of Lagos, officials say.
Witnesses told Reuters news agency they saw the Dana Air plane strike the two-storey building and burst into flames.
At least 162 people were thought to be on board, but the head of the Nigerian Civil Aviation Authority said he doubted any could have survived.

The crash took place in a neighbourhood just outside the airport in overcast weather, reports said.
Federal emergency personnel were said to be on their way to the scene.
There were conflicting reports as to whether the flight was arriving in Lagos from the Nigerian capital, Abuja, or was leaving Lagos bound for Abuja when the crash happened.
Nigeria, like many African countries, has a poor air safety record, though some efforts have been made to improve it since a spate of airline disasters in 2005.

STATEMENT: Mills Didn't Order The Dismissal Of Ashanti ECG Boss

Government has denied news reports indicating that the Ashanti Regional Manager of the Electricity Company of Ghana (ECG), Alhaji Abdulai Kurah, has been fired in the wake of difficulties with the flood lights at the Kumasi Sports Stadium on Friday.
 The Information Ministry, in a statement issued on Saturday and signed by the sector, Fritz Baffour said “the President has given no such directive and it is therefore not true that the ECG boss in the Ashanti region has been fired.”

This statement comes after the Communications Director at the Presidency, Koku Anyidoho, told PeaceFM's Anim Addo in an interview that the Ashanti Regional boss of the ECG has been fired with immediate effect for his role in the blackout that occurred during the World Cup qualifiers between Ghana and Lesotho on Friday evening. 


 According to him, the neck of all those on duty at ECG and all those who had something do with the matter are on the line.

"President Mills is upset and everybody who has a role to play in the matter will have their heads roll...This is unacceptable and the president is upset," Koku Anyidoho said.

But the Information Ministry says government has only directed an investigation to establish the cause of the failure of the flood lights in order for the appropriate corrective measures to be instituted against a recurrence in the future.

The statement issued by government also congratulated the Black Stars for their “outstanding performance and the massive goal harvest scored against Lesotho last night. The team will continue to enjoy the support of the government to enable the nation qualify for the next world cup tournament.”


 Meanwhile, Mr Anyidoho has accepted responsibility for the statement.

According to him, some senior persons in government took the rather rash decision to suspend the Ashanti Regional ECG boss.

Mr Koku Anyidoho told Joy FM's news analysis programme, Newsfile, Saturday he was with some senior persons when the decision was taken in the heat of the moment.

Gov't Double Speak On Suspension Of ECG Director?

There seems to be some form of confusion as to whether the Ashanti Regional Director of the Electricity Company of Ghana (ECG) has been suspended following the unprecedented national disgrace brought about by the suspension of the Ghana-Lesotho World Cup qualifier after flood lights at the Baba Yara Sports stadium went off for well over an hour.

 The Black Stars were leading by four(4) goals to nil with some fifteen minutes of the second half played, when referee Diatta Badara of Senegal stopped the match due to total darkness.

The Kenyan match commissioner Kasuve Titus Mutukku then gave the country's sports officials an hour to restore lights at the stadium, otherwise he will call the game off.

The embarrassing moment led to the Director of Communications at the presidency, Koku Anyidoho telling PeaceFM's Anim Addo in an interview that the Ashanti Regional boss of the ECG has been fired with immediate effect. 


 According to him, the neck of all those on duty at ECG and all those who had something do with the matter are on the line.

"President Mills is upset and everybody who has a role to play in the matter will have their heads roll...This is unacceptable and the president is upset," Koku Anyidoho said.

But there is doubt whether his statement carries any weight especially where the ECG claims it cannot be held responsible.

The Energy Ministry also say they have only called for an inquisition into the incident and have asked the ECG in Ashanti Region to furnish them (Ministry) with a report of what actually happened.


 The Public Relations Officer of the ECG, Erasmus Baidoo is rather blaming the National Sports Council. According to him, the Baba Yara Sports stadium was running on the generators of the Sports Council and that ECG was only a backup adding that there was power supplied by the ECG and that it was a switch on the generator of the Sports Council that developed a fault.

"There is no reason why there is no power in the stadium except that the generators of the Sports Council developed a problem...If flood lights went off, the ECG cannot be held accountable," he said.

Life Imprisonment to Hosni Mubarak Trial Verdict - 2 June 2012 Part 1

     

Former Egyptian President Hosni Mubarak has been found guilty of conspiracy in the killing of protesters during last year's uprising.

NEW WRITE UP BY MARTIN AMIDU


In the past few days I have made several disclosures which I believe to be a matter of public interest, which is why I am compelled to bring the following information to the notice of every patriotic Ghanaian to demand transparency and accountability in the manner the case of Balkan Energy (Ghana) Limited and the Attorney-General will be concluded.

This matter, like others raised, is contentious, but deserves to be concluded in the interest of the Republic of Ghana. I will feel very guilty if, because of the very enormous pressures from friends and some elders to abandon my advocacy work for the meantime, I kept the information to myself only for the above case to be settled in a manner inconsistent with the interest of the Republic of Ghana.

Hereafter I will take a temporary leave.

On 16th May 2012 the Supreme Court of Ghana unanimously declared the agreement between Balkan (Ghana) Limited and the Government of Ghana to be an international business transaction within the meaning of Article 181(5) of the 1992 Constitution which had to be laid before and approved by Parliament before it could become operative. The Supreme Court remitted the case back to the High Court for the Supreme Court’s interpretation of Article 181(5) of the Constitution to be applied to the proceedings before the High Court. The Balkan Ghana Agreement was never laid before and approved by Parliament.

On the same day and before the judgment could be signed and made available to the parties and the public it reliably came to my attention that Mr. Dan Markin, holding himself out as the Executive Chairman of Uniex Ghana Limited and acting on behalf of Zenith Bank (Ghana) Limited approached the Attorney-General for discussions towards a settlement of the case. He has since visited the Attorney-General’s Office again on the same subject. The antecedents of Mr. Dan Markin meddling in the Balkan case on behalf of Zenith Bank (Ghana) Limited gives credibility to me about the reports at my disposal.

Mr. Dan Markin is the Chairman of the Ghana Railways Development Authority. Mr. Dan Markin’s interest in settling the Balkan Energy (Ghana) Limited case first came to my notice on 22nd July 2011 in a letter written by Zenith Bank (Ghana) Limited addressed to the Executive Chairman, Uniex Ghana Limited requesting their mediation and consulting services to enable the Bank find a lasting solution to the mounting debt on their books for the OSAGYEFO BARGE PROJECT. The Bank’s letter stated further that:

“Subsequently, the Parties led by Balkan have sought arbitration in the Hague. While we have been looking forward to an expeditious resolution to the impasse with its effect on the settlement of the debt, the realization of the resolution seem to be dragging, whilst the debt keep mounting.

In the circumstances, your professional capability in resolving such intricate problems has been brought to the attention of BALKAN ENERGY, and they have indicated their no objection in having you step in without prejudice. We are also reliably informed that the Government of Ghana is also amenable to an expeditious resolution of the matter….” (Emphasis supplied).

Zenith Bank (Ghana) Limited’s letter was immediately followed by a letter from the Executive Chairman, Uniex Ghana Limited addressed to the Minister of Energy and copied to me as the Attorney-General amongst others asking for permission to mediate the dispute. The Uniex Ghana Limited letter was signed by Dan Markin as Executive Chairman.

I therefore immediately caused a search to be made at the Registrar-General’s Department only to realize that Uniex Ghana Limited was not registered as professional mediators or arbitrators. It also transpired that the Dan Markin who is the Executive Chairman is the same Dan Markin who is the Chairman of the Ghana Railways Development Authority, a public officer, bond by Articles 284 and 286(5)(g) in respect of conflict of interest and declaration of asserts. I declined the request in two written letters dated 16th August 2011 when I received the copy of the Uniex Ghana Limited letter and on 30th August 2011 in a written response to the Minister of Energy when Uniex Ghana Limited’s letter was eventually forwarded to me. Both letters have the same reference number D. 19/SF. 14.

In my view it was in the national interest to allow the Supreme Court which was seized with the matter to determine whether or not there was any enforceable contract between the Government of Ghana and Balkan Energy (Ghana) Limited under Article 181(5) of the Constitution. Balkan Energy (Ghana) Limited continued to pursue an arbitration against the Government of Ghana in spite of an injunction from the High Court restraining it from doing so. Balkan Energy (Ghana) Limited also consistently refused to allow a mutually agreed independent inspection of the OSAGYEFO BARGE to determine its state of repair. There was also overwhelming evidence from Government’s technical experts that the claim against Government was incompetent as Balkan Energy (Ghana) Limited was rather in default of its obligations to the Government. Both the Government’s Ghanaian and foreign external Solicitors agreed with me that it was not in the national interest to settle a case based upon a contract that may turn out after all to be unconstitutional.

I briefed the President about Dan Markin’s interest in meddling with the pending case. I also briefed the Chief of staff and made available to him a copy of the search results on Uniex Ghana Limited showing that our own Dan Markin and Chairman of the Ghana Railways Authority was unconstitutionally meddling in the pending Balkan case. I thought Dan Markin will be advised to stop meddling in the Attorney-General’s functions in the institution and conduct of civil proceeding for and against the Government under Article 88 of the Constitution.

I was, therefore, shocked to receive on the night of 15th October 2011 an e-mail with an attached letter of even date from the external solicitors of Balkan Energy (Ghana) Limited in Dallas, Texas, addressed to the Government of Ghana’s external Solicitors in New York stating, inter alia, that:

“For the first time yesterday I learned that a delegation from Ghana including Mr. Dan Markin (Chairman of Ghana Railways Development authority), Mr. Amar Quaye Amar (the Energy Advisor to the President of the Republic of Ghana), Dr. Peter Yamkey (sic) (Chief Executive Office of Ghana Gas Company) and joined by Mr. Daniel Asiedu (the current CEO of Zenith Bank Ghana) are coming to meet with the representatives of Balkan Energy (Ghana) Limited and Balkan Energy Company, LLC here in Dallas on Monday, October 17, 2011.

On behalf of myself and on behalf of the firms of NautaDutilh and Bentsi-Enchill Letsa & Ankomah I want to confirm that we were unaware and did not participate in the planning or scheduling of this meeting. Neither I nor representatives of NautaDutilh or Bentsi-Enchill Letsa & Ankomah plan to attend that meeting.

As I now understand it, the purpose of this meeting is to discuss resolution of claims pending in the above referenced arbitration and litigation in the Ghanaian High Court and Supreme Court….

I would appreciate it if you would advise me if you can confirm this on behalf of the Government of Ghana, both in the arbitration proceeding and in the pending proceedings in the Ghanaian courts, at your earliest immediate convenience.

I apologize for raising this on Saturday, but as I have indicated, it just came to my knowledge yesterday and I was only able to confirm the foregoing today…”

My prompt and immediate response by e-mail the same night of 15th October 2011 to the Government’s external solicitors after making enquiries from the Deputy Chief of Staff, Miss Dr. Sawyer, was as follows:

“Thanks for the mail. The Government of Ghana has not authorized anybody to mediate this case on its behalf. I have not as Attorney-General authorized the mediation and the Deputy Chief of Staff assures me that Government could not have authorized it without my concurrence. I am told that Yankey and Amar will not go for the alleged meeting. Dan Markin has himself been told not to hold out himself as representing the Government without express authority from my office. Regards.”

The Attorney-General’s written submissions for the referral of the Balkan (Ghana) Limited case to the Supreme Court for authoritative interpretation and arguments were conducted against the background of the foregoing illegal and unconstitutional meddling with the functions of the Attorney-General in representing the Government of Ghana. I had personally researched, written, and signed the statement of case in reply to the case of Balkan Energy (Ghana) Limited as the Interested Party and had same filed on 7th October 2011.

Surprisingly the Solicitor-General came to my office the day before the hearing of the application for referral for permission to withdraw our application from the Court because she had doubts about the case.

I did not tell her I was arguing the case myself until the next morning when I told her, to her delight, that I was going to the Court myself to argue the case. On 2 November 2011 the Supreme Court unanimously upheld the Government’s application and referred the interpretative issues to itself for interpretation. On 6th December 2011 the Supreme Court gave directions for the filling of Statements of Case by the parties.

I personally invested a lot of labour, sleepless nights and including the whole Christmas holidays for the research and writing of the Government’s Statement of Case which I signed to be filed on 28th December 2012 as ordered by the Court. I acknowledge the enormous suggestions and editorial support of the head of theGhana external Solicitors. Our suffering should not be rendered nugatory on grounds of personal conveniences.

It is important for the Ghanaian Public to know that on 23 December 2009 when Balkan Energy Ghana Limited instituted arbitration proceedings against the Government of Ghana, “Balkan’s claim was for US$50,000,000 plus interest based on a claim to a tolling fee under the PPA, with the claim expressed to be increasing by approximately US$4 million a month” This is the claim we fought on the grounds that there was no enforceable agreement under Article 181 (5) of the Constitution of Ghana to the Supreme Court and had judgment for the Government of Ghana.

The Supreme Court acknowledged my signed written statement of case and quoted extensively from it in its judgment.

This is the case Zenith Bank Ghana Limited wanted and wants Uniex Ghana Limited under the Executive Chairmanship of Dan Markin, who is also the constitutional Chairman of the Ghana Railways Development Authority to settle by mediation for Balkan Energy Ghana Limited.

I have lived the experience of some officials using their positions to facilitate settlements of cases which otherwise are very favourable to theRepublicofGhanato its disadvantage. The Balkan Energy (Ghana) Limited case coming again from the Ministry of Energy to be possibly settled gives me great worry and anxiety for the national interest.

Consequently, since I was informed of Dan Markin and Zenith Bank Ghana Limited’s overtures for the settlement of the Balkan Energy (Ghana) Limited case I have served notice on the Ghanaian external Solicitors that I will fight any settlement of the case that is not in the national interest with all my heart.

The Government of Ghana has an iron clad case against Balkan Energy( Ghana) Limited and it would be unconstitutional to settle a matter arising out of an unconstitutional contract when the matter has been remitted back to the High Court to dispose off as directed by the Supreme Court.

There is a very excellent article written by one Mr. J. Ato Kobbie, the Managing Editor of “The Business Analyst” on ghanaweb of Saturday 26 May 2012 on the claims of Balkan Energy for every patriotic member of the public to be further informed of what is at stake in the interest of the Republic of Ghana.

In conflict theory and practice structural violence occurs when the resources of a nation or community are expropriated by a few people for their personal use and thus depriving the consolidated fund and Government accounts of resources to provide life saving facilities for the majority of the citizenry. It is violence that is very lethal to the populace but cannot be seen with our naked eyes as we see physical violence.

Let’s save Ghana from such continuing structural violence and impunity.
